Changing Attitudes: Marijuana and Employment Testing in the Workplace

Shelley Peebles was thrilled to find a dental hygienist job in Austin after her hours were reduced at her previous job in New Braunfels, Texas. However, her excitement turned to worry when she learned she would need to pass a drug test. Despite using cannabis edibles for medical purposes, she decided to disclose her use and was surprised to still get the job.

Attitudes towards marijuana in the workplace are changing as more states legalize it. Some employers are dropping THC from pre-employment drug tests, while others are more lenient when candidates test positive. Companies in talent-strapped industries, like manufacturing, are even advertising that they don't require drug tests to attract applicants.

While most states have legalized marijuana in some form, employment laws don't protect its use. The origins of employer drug-testing date back to the Vietnam War. Some cities, known for their strict environments, are becoming more cannabis-friendly.

As marijuana gains acceptance, some employers believe eliminating testing makes sense. However, safety concerns remain, especially for positions involving heavy machinery or motor vehicles. Positive marijuana tests after workplace accidents have tripled, but it's unclear if it indicates working while high or off-duty use.

Drug testing can be a disadvantage for employers competing for talent. Many manufacturers have stopped testing workers for marijuana to attract more qualified candidates.

Employers must navigate the changing legal landscape and understand the laws in the areas they test. They need to determine if testing is necessary, develop protocols for handling impairment, and communicate rules clearly to employees.

For Shelley Peebles, open communication allowed her to get the job she wanted while using her medical cannabis products to improve her quality of life.
